1. Acceptance of Terms
By accessing or using PigeonFlow ("the Service"), operated by PigeonFlow ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Service
PigeonFlow is an omnichannel marketing automation platform that enables businesses to create and send marketing campaigns via email, SMS, and WhatsApp. The Service includes contact management, campaign creation, automation workflows, analytics and revenue attribution, and integrations with third-party platforms such as Shopify, WooCommerce, BigCommerce, Stripe, QuickBooks, and Xero.
3. Accounts & Registration
To use PigeonFlow, you must create an account and provide accurate information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of unauthorized access
- Ensuring that all users within your organization comply with these terms
4. Acceptable Use
You agree to use PigeonFlow only for lawful purposes and in compliance with all applicable laws, including but not limited to:
- Anti-Spam Laws: CAN-SPAM Act, GDPR, CASL, and other applicable email marketing regulations
- SMS Regulations: TCPA, CTIA guidelines, and applicable telecommunications laws
- WhatsApp Policies: WhatsApp Business API Terms of Service and Commerce Policy
- Data Protection: GDPR, CCPA, and other applicable privacy regulations
You must not use the Service to send unsolicited messages, harvest contact information without consent, distribute malware, or engage in any activity that could damage, disable, or impair the Service.
5. Messaging Compliance
When using our email, SMS, and WhatsApp marketing features, you are solely responsible for:
- Obtaining proper consent from recipients before sending messages
- Providing clear opt-out mechanisms and honoring unsubscribe requests
- Maintaining accurate records of consent for SMS and WhatsApp communications
- Ensuring message content complies with applicable laws and platform policies
- Respecting quiet hours and messaging frequency best practices
6. Payment Terms
PigeonFlow offers free and paid subscription plans. For paid plans:
- Fees are billed monthly or annually as selected at signup
- All fees are non-refundable except as required by law or stated in our refund policy
- We may change pricing with 30 days' notice; existing subscriptions are honored until their renewal date
- SMS and WhatsApp messages may incur additional per-message costs beyond your plan's included limits
- Failure to pay may result in suspension or termination of your account
7. Intellectual Property
The PigeonFlow platform, including its design, code, features, and documentation, is owned by us and protected by intellectual property laws. You retain ownership of all content you upload, including contact data, campaign content, and templates.
You grant us a limited license to use your content solely for the purpose of providing the Service. We will not use your content for any other purpose without your explicit consent.
8. Data & Privacy
Your use of PigeonFlow is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. You are responsible for complying with data protection laws when processing your contacts' personal data through our platform.
9. Third-Party Integrations
PigeonFlow integrates with third-party services including Shopify, WooCommerce, BigCommerce, Stripe, QuickBooks, Xero, SendGrid, and Twilio. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or practices of third-party services.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, and the Service may experience downtime due to factors beyond our control. We will make reasonable efforts to notify you of planned maintenance in advance.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR CONTINUOUSLY AVAILABLE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIGEONFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
13. Termination
You may terminate your account at any time from your account settings. We may suspend or terminate your account if:
- You violate these Terms of Service
- Your messaging practices result in high spam complaints or delivery issues
- You fail to pay applicable fees
- Required by law or to protect the integrity of our Service
Upon termination, you may request export of your data within 30 days. After that period, your data will be permanently deleted.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts located in Cook County, Illinois.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after changes are effective constitutes acceptance of the updated Terms.
